Article 2. Applicability

  1. These general terms and conditions apply to every offer made by Quack Collectables and to every distance contract concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer electronically.

Article 3. The Offer & Pricing

  1. The offer contains a complete and accurate description of the products offered, sufficiently detailed to enable a proper assessment by the consumer.
  2. All stated prices include statutory VAT, or fall under the margin scheme (if specifically stated with the product), and exclude shipping costs.
  3. Obvious mistakes or evident errors in the offer (such as a clearly incorrect pricing) are not binding on the entrepreneur.
  4. Prices of Trading Card Game (TCG) products are subject to market fluctuations. The price at the time of concluding the agreement is binding.

Article 4. Pre-Orders and Allocations

  1. When purchasing products that have not yet been released (pre-orders), the stated release date serves as an indication. This date is determined by the manufacturer and is subject to change.
  2. Quack Collectables depends on allocations by external distributors. If we receive less stock than ordered, Quack Collectables reserves the right to (partially) cancel pre-orders. Any amounts already paid will be fully refunded within 5 working days in such cases.

Article 5. Delivery and Execution

  1. The place of delivery is the address that the consumer has made known to Quack Collectables.
  2. Quack Collectables aims to dispatch accepted orders within 1 to 3 working days, unless a different delivery period has been agreed upon (e.g., in the case of pre-orders).
  3. The risk of damage and/or loss of products rests with Quack Collectables until the moment of delivery to the consumer or a pre-designated representative.

Article 6. Right of Withdrawal (Returns)

  1. The consumer has the right to dissolve the agreement during a cooling-off period of 14 days without giving any reason. This period starts on the day after the consumer receives the product.
  2. During the cooling-off period, the consumer shall handle the product and its packaging with care. The product may only be inspected to the extent necessary to establish its nature and characteristics.

Article 7. Exclusion of Right of Withdrawal (TCG Clause) Given the specific nature and valuation of Trading Card Game products, the right of withdrawal is explicitly excluded for the following products:

  1. Sealed products (such as Booster Boxes, Elite Trainer Boxes, Blisters, Collection Boxes, and individual Booster Packs) whose original factory seal (shrink wrap/foil) has been broken or damaged after delivery. Breaking the seal results in a direct 100% depreciation in value regarding returnability.
  2. Single cards (Singles) whose condition has been altered after delivery, or which have been removed by the consumer from any sealed protective sleeves (such as ‘sealed toploaders’ or ‘graded slabs’).

Article 8. Warranty and Conformity

  1. Quack Collectables guarantees that the products comply with the agreement and the specifications stated in the offer.
  2. Specifically for TCG products, Quack Collectables never offers a guarantee on the contents of closed packaging regarding the rarity, value, or distribution of specific cards (so-called “pull rates”).
  3. In the case of obvious manufacturing defects in originally closed packaging (such as a missing promo card in a sealed box), Quack Collectables will act as the first point of contact to resolve this with the distributor or manufacturer on behalf of the consumer.

Article 9. Complaints Procedure and Disputes

  1. Complaints about the execution of the agreement must be submitted fully and clearly described to info@quackcollectables.nl within a reasonable time after the consumer has discovered the defects.
  2. Complaints submitted will be answered within 14 days calculated from the date of receipt.
  3. If the complaint cannot be resolved by mutual agreement, the consumer can also turn to the European ODR platform (Online Dispute Resolution) via http://ec.europa.eu/odr for dispute resolution.
